Terms of Service

1. Agreement

By accessing or using SpamSlap AI ("Service"), you agree to be bound by these Terms of Service. The Service is provided by FIXFLEX LTD ("we", "us", "our"), a company registered in England and Wales, company no. 08944523, registered office: 170 Connell Crescent, London, W5 3BP.

2. The Service

SpamSlap AI is an AI-powered spam detection tool for web contact forms. It classifies contact form submissions in real time using AI and generates contextual responses to detected spam messages.

3. Your Account

• You must provide a valid email address to create an account
• You are responsible for keeping your API key secure
• You must not share, publish, or resell your API key
• One account per person or business entity
• You must be at least 18 years old or have parental consent

4. Acceptable Use

You may not use SpamSlap AI to:

• Process forms that collect sensitive personal data (medical records, financial credentials, passwords)
• Violate any applicable laws or regulations
• Attempt to reverse engineer, decompile, or extract the AI models or service logic
• Abuse the API in ways that degrade performance for other users
• Use the Service for purposes other than spam protection of web forms

5. Trial and Billing

• Automatic renewal: paid plans are monthly subscriptions that renew automatically each month, charged to your card via Stripe, until you cancel
• Cancellation: anytime, no minimum term, no cancellation fee — click Manage / cancel subscription in your dashboard (Stripe customer portal) or email us. Cancellation takes effect at the end of the current paid month; you keep access until then
• Right to cancel (consumers): if you buy as a consumer, you have 14 days from purchase to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. At checkout you ask us to start the service immediately; if you then cancel within the 14 days, we refund what you paid minus a proportionate amount for the service already provided (pro-rata). Once the service has been fully provided for a paid period, the right to cancel for that period ends. We confirm your request and this acknowledgement by email
• Business customers: the statutory right to cancel does not apply, but you can cancel the subscription at any time as described above
• Prices are in GBP and inclusive of applicable VAT

6. Uptime and Reliability

• We target 99% monthly uptime but do not guarantee it
• If our service cannot be reached (network error or outage), the SpamSlap script lets your form submit normally, without AI review (fail-open)
• If our service is reachable but the AI check cannot be completed (both AI providers unavailable), the message is not delivered unchecked: it is held in a moderation queue in your dashboard until it is reviewed, and the visitor is told their message is being held (fail-closed)
• We are not liable for spam messages that pass through during downtime or service interruptions, or for delays caused by held messages

7. AI Accuracy

• SpamSlap AI uses AI classification which is not 100% accurate
• False positives (legitimate messages blocked) may occasionally occur
• We recommend monitoring your dashboard regularly and using the whitelist feature for trusted senders
• We are not liable for legitimate messages that were incorrectly blocked

8. Hall of Shame

SpamSlap AI may operate a public "Hall of Shame" feature displaying notable spam attempts.

• By using the Service, you grant FixFlex LTD the right to display spam log entries publicly in anonymized form
• Spammer email addresses are anonymized before display (e.g. s***@domain.com)
• No personal data of legitimate senders is ever displayed
• To request removal of a specific entry: [email protected]

9. Termination

We may suspend or terminate your account if:

• You violate these Terms of Service
• Payment fails and is not resolved within a 7-day grace period
• We detect abuse of the Service (e.g. excessive API calls, sharing API keys)

You may cancel your subscription at any time from your dashboard (Manage / cancel subscription, which opens the Stripe customer portal) or by emailing us.

10. Data Processing (UK GDPR Article 28)

When you use SpamSlap AI on your website, you are the controller of the personal data in the messages sent through your forms, and FIXFLEX LTD acts as your processor. This section forms the data processing agreement between us.

• Subject matter and purpose: classifying form submissions as spam or genuine, showing results in your dashboard and holding messages for review when the AI check cannot be completed
• Duration: for as long as you use the Service, plus the retention periods in our Privacy Policy
• Data subjects and data: people who submit your forms — name, email address, message text, IP address, and your domain
• Instructions: we process this data only to provide the Service as described in these Terms, which are your documented instructions, unless the law requires otherwise
• Confidentiality and security: access is limited to people who need it and are bound by confidentiality; data is encrypted in transit (HTTPS) and stored on access-controlled servers
• Sub-processors: you authorise OpenRouter (United States), which passes the message to Google's Gemini model for classification, and our hosting provider. If OpenRouter is unavailable, a model running on our own server is used. We will tell you by email before adding or replacing a sub-processor, so you can object
• International transfers: transfers outside the UK rely on the UK International Data Transfer Agreement, the UK Addendum to the EU Standard Contractual Clauses, or UK adequacy regulations, as offered by the sub-processor
• Assistance: we help you answer data subject requests and meet your security, breach-notification and impact-assessment obligations, taking into account the information available to us
• Personal data breaches: we notify you without undue delay after becoming aware of a breach affecting your data
• Deletion: spam logs and resolved held messages are deleted automatically after 90 days; when your account ends, we delete the remaining data within 30 days, except where the law requires us to keep it
• Audits: we make available the information needed to show compliance with this section and respond to reasonable audit requests

11. Limitation of Liability

To the maximum extent permitted by applicable law, FixFlex LTD's total liability to you for any claims arising under these Terms is limited to the amount you paid to us in the 30 days preceding the claim.

We are not liable for indirect, incidental, or consequential damages including lost business, lost revenue, or data loss.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by email at least 30 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
